1 Acceptance of Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Scholarly Apps ("Company," "we," "our," or "us") governing your access to and use of the PathLingo mobile application ("App") and all related services, content, features, and functionality (collectively, the "Services").
By downloading, installing, registering for, or using PathLingo, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree with any part of these Terms, you must not use the Services.
Important: Your continued use of PathLingo after any changes to these Terms constitutes acceptance of those changes. We recommend reviewing these Terms periodically.
2 Definitions
Throughout these Terms, the following definitions apply:
- "App" refers to PathLingo, the mobile application developed and published by Scholarly Apps, available on Google Play Store, Apple App Store, and other authorized platforms.
- "Services" refers to all features, content, functionality, and tools provided through the App, including language lessons, quizzes, vocabulary practice, pronunciation tools, progress tracking, and any related websites or services.
- "User Content" means any content, data, text, audio recordings, or other materials that you create, upload, submit, or transmit through the Services.
- "Company Content" means all content provided by Scholarly Apps through the Services, including but not limited to lessons, quizzes, translations, audio files, images, designs, logos, software code, and documentation.
- "Account" refers to the personal account created by a User to access the full features of the Services.
- "Device" means any mobile phone, tablet, computer, or other electronic device used to access the Services.
- "Third-Party Services" refers to external services, applications, websites, or platforms that integrate with or are linked from the App.
3 Eligibility
3.1 Age Requirements
PathLingo is available to users of all ages. However, specific requirements apply based on your age:
- Users aged 13 and older (or the applicable age of digital consent in your jurisdiction) may create an account and use the Services independently.
- Users under 13 years of age (or the applicable age in your jurisdiction) must have verifiable parental or guardian consent before creating an account. Parents or guardians are responsible for their child's use of the Services and agree to these Terms on their behalf.
- Users under 16 in the EU/EEA require parental consent as required by GDPR. The specific age may vary by EU member state.
3.2 Legal Capacity
By agreeing to these Terms, you represent and warrant that you have the legal capacity to enter into a binding agreement (or that a parent/guardian consents on your behalf), that you are not barred from using the Services under any applicable laws, and that your use of the Services will comply with all applicable local, state, national, and international laws and regulations.
3.3 Account Accuracy
You agree to provide accurate, current, and complete information during registration and to keep your account information updated. Providing false, misleading, or fraudulent information may result in account suspension or termination.
4 Account Registration & Security
4.1 Account Creation
To access certain features of PathLingo, you may need to create an account. You can register using your email address or through supported third-party sign-in providers (such as Google or Apple Sign-In). Some basic features may be available without an account.
4.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Create a strong, unique password for your PathLingo account.
- Not share your account credentials with any other person.
- Immediately notify us at info@scholarlyapps.com of any unauthorized use of your account or any other security breach.
- Not create multiple accounts for the purpose of circumventing any restrictions or abusing the Services.
4.3 Account Termination by User
You may delete your account at any time through the App settings (Settings → Account → Delete Account) or by contacting us. Upon account deletion, your personal data will be handled in accordance with our Privacy Policy. Please note that certain data may be retained as required by law or for legitimate business purposes.
Note: Deleting your account is permanent and cannot be undone. All learning progress, streaks, XP, and associated data will be permanently removed within 30 days of your request.
5 License & App Usage
5.1 License Grant
Subject to your compliance with these Terms, Scholarly Apps grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use PathLingo on Devices you own or control, solely for your personal, non-commercial, educational purposes.
5.2 License Restrictions
You agree that you will not:
- Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the App or any portion thereof.
- Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices contained in or on the App.
- Use the App for any commercial purpose without prior written consent from Scholarly Apps.
- Distribute, license, sell, rent, lease, transfer, or otherwise make the App or its content available to any third party.
- Use the App in any manner that could disable, overburden, damage, or impair our servers or networks.
- Use any automated system, bot, scraper, or spider to access the Services for any purpose.
- Attempt to gain unauthorized access to any part of the Services, other users' accounts, or any computer systems or networks connected to the Services.
- Use the App to develop a competing product or service.
5.3 Updates & Modifications
We may from time to time release updates, patches, bug fixes, or new versions of the App. You agree that we may automatically update the App on your Device. Some updates may be required for continued use of the Services. We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice.
5.4 Open Source Components
PathLingo may include open-source software components. Such components are subject to their respective open-source licenses, which will prevail over these Terms in the event of a conflict regarding those components. A list of open-source components and their licenses is available within the App under Settings → About → Open Source Licenses.
6 Free Service & Optional Premium Features
6.1 Free Core Service
PathLingo's core language learning features are provided free of charge. This includes access to beginner lessons, quizzes, vocabulary practice, pronunciation tools, streak tracking, and progress dashboards across all available languages. We are committed to keeping our core educational features free and accessible.
6.2 Optional Premium Features
We may, now or in the future, offer optional premium features, enhancements, or content ("Premium Features") for purchase. If Premium Features are offered:
- Pricing and payment terms will be clearly disclosed before purchase.
- All purchases are processed through the respective platform's payment system (Google Play Billing, Apple In-App Purchase).
- Premium subscriptions may auto-renew unless cancelled at least 24 hours before the end of the current billing period.
- You can manage or cancel subscriptions through your Google Play or Apple App Store account settings.
6.3 Refunds
Refund policies for in-app purchases are governed by the respective platform's refund policies:
- Google Play: Refunds follow Google Play's refund policy.

6.4 No Obligation for Future Free Access
While we intend to keep core features free, we reserve the right to modify the scope of free features or introduce new pricing structures with reasonable notice. Any changes will not affect existing paid subscriptions during their current term.
7 User Content
7.1 Ownership
You retain all ownership rights in and to any User Content you create, submit, or transmit through the Services. Scholarly Apps does not claim ownership over your User Content.
7.2 License to Scholarly Apps
By submitting User Content through the Services, you grant Scholarly Apps a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content solely for the purposes of operating, developing, providing, promoting, and improving the Services. This license terminates when you delete your User Content or your account, except where your content has been shared with others and they have not deleted it, or where retention is required by law.
7.3 User Content Responsibilities
You are solely responsible for your User Content and represent and warrant that:
- You own or have all necessary rights, permissions, and licenses to submit the User Content.
- Your User Content does not violate any third party's intellectual property rights, privacy rights, publicity rights, or any other personal or proprietary rights.
- Your User Content does not contain any defamatory, obscene, offensive, threatening, or otherwise objectionable material.
- Your User Content is accurate and not misleading.
7.4 Audio Recordings
When you use pronunciation features, audio recordings may be temporarily processed to provide pronunciation feedback. By opting in to contribute pronunciation data for improving our speech recognition models, you grant us a non-exclusive, perpetual, irrevocable license to use anonymized versions of such recordings for training and improving our AI models. You can opt out at any time in Settings → Privacy & Data.
8 Prohibited Conduct
You agree not to engage in any of the following prohibited activities while using the Services:
8.1 Illegal & Harmful Activities
- Using the Services for any unlawful purpose or in violation of any local, state, national, or international law.
- Harassing, threatening, bullying, intimidating, or abusing any other user or Scholarly Apps personnel.
- Promoting violence, discrimination, hatred, or harassment against any individual or group.
- Impersonating any person or entity, or falsely representing your affiliation with any person or entity.
- Engaging in any activity that exploits, harms, or threatens to harm minors in any way.
8.2 Technical Abuse
- Introducing viruses, malware, trojans, worms, logic bombs, or any other material that is malicious or technologically harmful.
- Attempting to gain unauthorized access to, interfere with, damage, or disrupt any part of the Services, servers, or databases.
- Using any automated means (bots, crawlers, scrapers) to access the Services without our express written permission.
- Performing any denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks against our infrastructure.
- Circumventing, disabling, or otherwise interfering with security-related features of the App.
8.3 Content & Intellectual Property Abuse
- Copying, distributing, or disclosing any part of the Services in any medium without authorization.
- Systematically downloading or storing Company Content for redistribution or commercial use.
- Using the Services to infringe upon the intellectual property rights of any third party.
- Removing or altering any proprietary notices, labels, or marks on the Services.
8.4 Account Abuse
- Creating multiple accounts to exploit free features, circumvent limitations, or artificially inflate statistics.
- Selling, transferring, or sharing your account with any other person.
- Using another user's account without their permission.
- Manipulating streaks, XP, progress data, or any gamification elements through unauthorized means.
Consequences: Violation of any prohibited conduct may result in immediate account suspension or permanent termination, removal of User Content, and reporting to appropriate law enforcement authorities where applicable.
9 Intellectual Property Rights
9.1 Company Ownership
The Services, including but not limited to the App, its design, layout, look-and-feel, and all Company Content — such as text, graphics, images, audio, video, software code, algorithms, educational content, lesson structures, quizzes, and documentation — are the exclusive property of Scholarly Apps or its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
9.2 Trademarks
"Scholarly Apps," "PathLingo," and all related names, logos, product and service names, designs, and slogans are trademarks of Scholarly Apps. You must not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on the App are the trademarks of their respective owners.
9.3 Feedback
If you provide us with any feedback, ideas, suggestions, or recommendations regarding the Services ("Feedback"), you acknowledge that we may use such Feedback without any obligation to compensate you and without any restriction on use. You hereby assign to Scholarly Apps all rights, title, and interest in and to such Feedback.
9.4 DMCA / Copyright Infringement
We respect the intellectual property rights of others. If you believe that any content on PathLingo infringes your copyright, please submit a notice to our designated copyright agent at info@scholarlyapps.com containing:
- A description of the copyrighted work you claim has been infringed.
- A description of where the allegedly infringing material is located within the App.
- Your contact information (name, address, telephone number, email).
- A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
- Your physical or electronic signature.
10 Third-Party Services & Links
10.1 Third-Party Integrations
PathLingo may integrate with or contain links to third-party services, websites, or applications that are not owned or controlled by Scholarly Apps. These include, but are not limited to, authentication providers (Google, Apple), analytics services, cloud infrastructure providers, and speech recognition APIs.
10.2 No Endorsement or Liability
The inclusion of any third-party integration or link does not imply endorsement, approval, or recommendation by Scholarly Apps. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party services. You acknowledge and agree that Scholarly Apps shall not be responsible or liable for any damage or loss caused by your use of or reliance on any third-party services.
10.3 Platform Terms
Your use of PathLingo is also subject to the terms and conditions of the platform through which you access the App:

In the event of any conflict between these Terms and the applicable platform terms, these Terms shall govern the relationship between you and Scholarly Apps, while the platform terms shall govern the relationship between you and the platform provider.
11 Disclaimers

11.1 "As-Is" Basis
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SCHOLARLY APPS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
11.2 No Guarantee of Results
Scholarly Apps does not warrant or guarantee that:
- The Services will meet your specific requirements or expectations.
- The Services will be uninterrupted, timely, secure, or error-free.
- The results obtained from using the Services will be accurate, reliable, or complete.
- Any errors in the Services will be corrected.
- You will achieve any specific level of language proficiency by using PathLingo.
11.3 Educational Tool Disclaimer
PathLingo is designed as a supplementary educational tool for beginner language learning. It is not intended to replace formal language education, academic programs, certified instructors, or professional language training. The content provided through the Services is for general educational purposes only and should not be relied upon as the sole source of language instruction.
11.4 AI & Speech Recognition Disclaimer
Pronunciation feedback and speech recognition features utilize artificial intelligence and machine learning technologies. These technologies are continually improving but may occasionally provide inaccurate feedback. The pronunciation scores and assessments provided should be treated as guidance and are not a definitive measure of your pronunciation abilities.
11.5 Content Accuracy
While we make reasonable efforts to ensure the accuracy of translations, lessons, and educational content, language is complex and nuanced. We do not guarantee that all content is free from errors, and we are not liable for any consequences arising from inaccuracies in the educational content.
12 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SCHOLARLY APPS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR:
12.1 Types of Excluded Damages
- Any indirect, incidental, special, consequential, exemplary, or punitive damages.
- Any loss of profits, revenue, data, goodwill, or other intangible losses.
- Any damages arising from your access to, use of, or inability to access or use the Services.
- Any damages arising from any content obtained from the Services.
- Any damages arising from unauthorized access, use, or alteration of your transmissions or content.
- Any damages arising from any third-party conduct or content on or through the Services.
12.2 Liability Cap
IN NO EVENT SHALL SCHOLARLY APPS' TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF THE SERVICES EXCEED THE GREATER OF: (A) THE AMOUNT YOU HAVE PAID TO SCHOLARLY APPS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS (USD $100.00).
12.3 Jurisdictional Limitations
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law. Nothing in these Terms excludes or limits our liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded by law.
13 Indemnification
You agree to defend, indemnify, and hold harmless Scholarly Apps, its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms.
- Your User Content.
- Your violation of any third party's rights, including intellectual property rights, privacy rights, or publicity rights.
- Your violation of any applicable law, rule, or regulation.
- Any misrepresentation made by you.
- Any dispute between you and any third party.
We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with our defense of such claim.
14 Termination
14.1 Termination by You
You may terminate your agreement with us at any time by deleting your account through the App settings or by contacting our support team. Upon termination, your right to use the Services will immediately cease.
14.2 Termination by Scholarly Apps
We may suspend or terminate your account and access to the Services, in whole or in part, at our sole discretion, without prior notice or liability, for any reason, including but not limited to:
- Breach or violation of these Terms.
- Engaging in prohibited conduct as described in Section 8.
- Requests by law enforcement or other government agencies.
- Discontinuation or material modification of the Services.
- Extended periods of inactivity (accounts inactive for more than 24 months may be scheduled for deletion with prior notice).
- Unexpected technical or security issues.
14.3 Effect of Termination
Upon termination of your account:
- Your license to use the Services is immediately revoked.
- We may delete your account data in accordance with our Privacy Policy.
- Any provisions of these Terms that by their nature should survive termination shall survive, including but not limited to: ownership provisions, warranty disclaimers, indemnification, limitations of liability, and dispute resolution.
- Outstanding payment obligations (if any) remain due.
Data Export: Before deleting your account, you may request a copy of your data through Settings → Privacy & Data → Export My Data. We will provide your data in a portable format (JSON/CSV) within 30 days of your request.
15 Dispute Resolution
15.1 Informal Resolution
Before filing any formal legal action, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Services ("Dispute") informally by contacting us at info@scholarlyapps.com. We will attempt to resolve the Dispute informally within 60 days of receiving your notice. If the Dispute is not resolved within this period, either party may proceed with formal dispute resolution.
15.2 Binding Arbitration
If informal resolution is unsuccessful, any Dispute shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. The arbitration will be conducted in the English language and held in San Francisco, California, USA, or at another mutually agreed location. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
15.3 Class Action Waiver
YOU AND SCHOLARLY APPS AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than in arbitration, both you and Scholarly Apps waive any right to a jury trial.
15.4 Exceptions
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights. Additionally, disputes relating to small claims may be brought in small claims court.
15.5 EU/EEA Residents
If you are a consumer in the European Union or European Economic Area, the mandatory consumer protection laws of your country of residence apply, and you may bring proceedings in the courts of your country of residence. You may also be able to use the European Commission's Online Dispute Resolution platform.
16 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law provisions. This choice of law provision is not intended to deprive you of the protection of the mandatory consumer protection provisions of the country in which you reside.
Any legal action or proceeding arising out of or relating to these Terms that is not subject to arbitration shall be brought exclusively in the federal or state courts located in San Francisco County, California, and you consent to the personal jurisdiction of such courts.
17 Modifications to These Terms
Scholarly Apps reserves the right to modify, update, or revise these Terms at any time at our sole discretion. When we make changes:
- We will update the "Effective Date" and "Last Updated" date at the top of this page.
- For material changes that significantly affect your rights or obligations, we will provide at least 30 days' advance notice via in-app notification, email, or prominent notice within the App before the changes take effect.
- We will provide a clear summary of changes to help you understand what has been modified.
- For non-material changes (such as clarifications, formatting, or minor updates), we may update the Terms without advance notice.
- Where required by law (such as under GDPR), we will obtain your explicit consent before applying changes that materially affect how your personal data is processed.
Your continued use of the Services after the effective date of any revised Terms constitutes your acceptance of the changes. If you do not agree with any changes, you must stop using the Services and delete your account.

18 General Provisions
18.1 Entire Agreement
These Terms, together with the Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and Scholarly Apps regarding the Services and supersede all prior agreements, representations, and understandings.
18.2 Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
18.3 Waiver
The failure of Scholarly Apps to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if made in writing and signed by Scholarly Apps.
18.4 Assignment
You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.
18.5 Force Majeure
Scholarly Apps shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, wars, terrorism, riots, pandemics, government actions, power failures, internet or telecommunications outages, or labor disputes.
18.6 Notices
Any notices or communications from Scholarly Apps to you will be delivered via email (to the address associated with your account), in-app notification, or by posting on the App. You are responsible for keeping your contact information up to date. Notices to Scholarly Apps should be sent to info@scholarlyapps.com.
18.7 No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights, except that the platform providers (Google, Apple) are intended third-party beneficiaries of these Terms as they relate to your use of the App distributed through their platforms. Platform providers have the right to enforce these Terms against you as a third-party beneficiary thereof.
18.8 Headings
The headings in these Terms are for convenience only and have no legal or contractual effect.
